Terms of Service.

These terms are a binding agreement between you and the operator of PhotoSale.net (the site). By using the site you agree to them. If you do not agree, do not use the site.

1. Who can use PhotoSale

You must be at least 18 years old or have a parent or guardian agree on your behalf. You must give correct details when you create an account and keep your login secure. You are responsible for everything done through your account.

2. What the site is

PhotoSale is a directory and marketplace. We list photographers, their prints, and licensable photos. We facilitate enquiries and transactions. We are not a party to the work a photographer performs for a buyer, except where we are the named seller for a specific print or licence.

3. Accounts

• Photographer accounts must use a real legal or trading name and a working contact email.
• We can suspend or remove any account at our discretion, including for breaches of these terms, the photographer agreement, the copyright policy, or the AI image policy.
• Buyer accounts are for individuals or businesses making genuine purchase or licensing enquiries.

4. Content rules

You may not upload, submit, or list:

• Material that infringes someone else's copyright.
• AI-generated or AI-manipulated images presented as photographs.
• Identifiable photos of minors, or photos taken in breach of privacy law, surveillance device legislation, or cultural heritage protections.
• Defamatory, harassing, or unlawful content.
• Photos that misrepresent the location, time, or subject in a way that would mislead a reasonable buyer.

5. Payments and fees

Print orders and licence fees are processed by our payment providers. Our share of each transaction is set out in the photographer agreement. Prices include GST where applicable.

6. Refunds

Digital licence purchases are not refundable once the download is delivered, except where required by the Australian Consumer Law. Print orders follow the printer's standard policy and are replaceable if the goods arrive damaged or do not match the listing in a material way.

7. Hire enquiries

Hire enquiries are forwarded to the photographer for a direct response. Any contract for hire work is between the photographer and the buyer. We are not a party to that contract and are not responsible for the work or for any dispute that arises from it.

8. Intellectual property

Photographers retain copyright in their photos. Buyers receive only the rights set out in the relevant licence. The PhotoSale name, logo, and site design are owned by us and may not be used without written permission.

9. Acceptable use

• No scraping, automated harvesting, or bulk download.
• No reverse engineering of the site.
• No use of the site to send unsolicited commercial messages.
• No attempts to bypass paywalls, watermarks, or licence terms.

10. Disclaimers

We do everything we reasonably can to keep the site running, the listings accurate, and the photographers real. We do not warrant that the site will be uninterrupted, that listings will be free of errors, or that any photographer will produce specific results. Nothing in these terms excludes a right or remedy that cannot be excluded under the Australian Consumer Law.

11. Liability

To the extent the law allows, our liability for any claim arising out of your use of the site is limited to the fees we received from you in the twelve months before the claim. We are not liable for indirect or consequential loss.

12. Governing law

These terms are governed by the laws of Western Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Western Australia.

13. Changes

We may update these terms. Material changes will be flagged on this page with a new last-updated date. Continued use of the site after a change means you accept the new terms.
