Photographer Agreement.

This agreement covers your relationship with PhotoSale as a listed photographer. It sits on top of the terms of service and the copyright policy. If the two ever conflict on a photographer-specific point, this agreement wins.

1. You keep copyright

Every photo you upload stays yours. PhotoSale never claims copyright in your work. We do not transfer your photos to other photographers, partners, or training datasets.

2. The licence you grant us

For each photo you list, you grant PhotoSale a non-exclusive, royalty-free, worldwide licence to display the photo on the platform, to add a small watermark to the public preview, to generate the technical formats and sizes the site needs (such as thumbnails and responsive variants), and to advertise the platform using a small selection of public listings.

This licence is limited to what is needed to operate PhotoSale and promote your work on it. It ends when you remove the photo from the site or close your account, except where a buyer has already bought a licence (their licence stays valid).

3. What you confirm when you upload

  • You took the photo, or you hold the rights to license it.
  • The photo is not generated or substantially manipulated by AI.
  • You have any model release or property release the photo needs for the use you have marked it for.
  • The photo does not breach the privacy, defamation, surveillance device, or cultural heritage laws that apply where it was taken.

4. Categories of sale

  • Prints: physical prints sold through the site, fulfilled by you or by a print partner.
  • Licences: editorial or commercial use rights sold by photo, scope, and term. See the buyer licensing terms for the standard scopes.
  • Hire: enquiries for shoots you take on. PhotoSale forwards the enquiry and steps back. The hire contract is between you and the buyer.

5. Revenue share

Default platform fee is 10 percent of the gross sale price on prints and licences sold through PhotoSale. You set your own prices. We do not take a cut of hire jobs that originate as enquiries, since we do not handle the payment for those.

Stripe processing fees come out of the gross amount before the split. Australian GST is added on top of buyer-facing prices where applicable, and we remit it.

6. Payouts

Payouts run on a monthly cycle. Cleared sales from the previous calendar month are paid on the 15th of the following month, to the bank details on your account. You are responsible for the income tax and any GST that flows from your sales.

7. Your responsibilities

  • Keep your contact email working. Enquiries go straight to it.
  • Reply to enquiries promptly, even if the answer is no.
  • Honour the licence terms a buyer purchased.
  • Update your bank details when they change.
  • Tell us if your ABN or GST status changes.

8. Our responsibilities

  • Keep the site running and your listings reachable.
  • Process payments and pay you on time.
  • Act on copyright and removal notices that target your work.
  • Not share your contact details with third parties beyond what is needed to fulfil orders.

9. AI training is not permitted

Photos hosted on PhotoSale may not be scraped or used to train machine learning models. We block known training crawlers in robots.txt and assert the noai signal. We will pursue training users with the legal tools available. See the AI image policy.

10. Suspension or removal

We can suspend or remove your account for breaches of this agreement, the terms of service, or the copyright policy. We will give you reasons in writing. Genuine accidents and one-off mistakes are handled by a warning. Repeat or wilful breaches are handled by removal.

11. Leaving

You can close your account any time. We remove your public profile and your listed photos within 30 days. We retain order records and payout records for seven years for tax purposes, and we keep buyer-issued licences valid for the terms they were sold under.

12. Liability

You are liable for the content you upload and the work you do for buyers you connect with through PhotoSale. PhotoSale is not liable for your tax, your insurance, or any contract you sign with a client. Standard exclusions in the terms of service apply.

13. Changes

We may update this agreement. Material changes will be flagged on this page with a new last-updated date and emailed to your account address at least 14 days before they take effect.
